Traders

Outcome: Your company is a so-called 'trader' or 'SME operator*' for the EUDR.

As a trader or SME-operator*, you have the following obligations:

Collecting data from suppliers and customers:

  • Name
  • Trade name / trademark
  • Postal address
  • E-mail address
  • Internet address (if applicable)

NOTE: You must also provide your customer with the reference numbers of due diligence statements for each order.

Other obligations are:

  • 5-year retention period
  • Notification in case of indications that the prohibition has been violated
  • Cooperation with competent authority

In addition, your customers may have (other) obligations, such as collecting information on the origin of the product or raw material and whether deforestation and forest degradation have not taken place. They will want to obtain this information from the upstream supply chain. To find out what obligations your customers have, we recommend that you perform this check again for your customer yourself. You can also inform your customer of this check.

* If your products (or parts of them) do not yet have a due diligence statement, the obligations of an 'ordinary' operator apply.
